Lead-Based Paint Testing

Federal regulations require lead-based paint testing in target housing (pre-1978) or to treat all paint as lead contaminated. The Texas Department of Health has specific regulations concerning inspection and manipulation of lead-based paint.

It is our understanding that HUD, in the near future, will require a lead-based paint inspection and / or a lead-based paint risk assessment on HUD-funded properties and / or target properties.

Esesis Environmental is a Texas Department of State Health Services licensed lead firm, with appropriately licensed lead inspectors and lead risk assessors.

We own a Heuresis Pb200i Handheld XRF Lead Paint Analyzer.

This instrument will allow us to test with minimal damage, in most cases no damage, and to have immediate results available for verbal reporting. Final reporting is available in approximately 7 working days after completion of the inspection process.

Normally, single-family homes will take 2 to 4 hours at the site for inspection with 200 to 600 samples normally taken. This time and sample difference is determined by the number of rooms and different paint combinations in residence.

We have successfully inspected commercial spaces, school, single family and multi-family homes throughout the state of Texas.

About Lead​

Lead is a heavy metal that has long been used in the manufacture of paint, plumbing pipes and solder, leaded gasoline, and other products. Lead poisoning is a serious illness caused by swallowing or inhaling lead.

We are all at risk for lead poisoning, but children under the age of six, pregnant women, and the elderly (65 and older) are at the greatest risk for lead poisoning. Young children tend to ingest or inhale more lead than adults because of their hand-to-mouth activity.

Most children who have lead poisoning do not act sick or show symptoms, though some may be irritable, have stomach aches or show little interest in eating.

What Is a Lead-Based Paint "Hazard"?

A lead-based paint "hazard" is any condition that causes exposure to lead from lead-contaminated dust, lead-contaminated soil, or lead-contaminated paint that is deteriorated or is present in accessible surfaces, friction surfaces, or impact surfaces that would result in adverse human health effects, as established by the appropriate federal agency. Peeling, chipping, chalking or cracking lead-based paint is a hazard that needs immediate attention.

The impacts of lead poisoning include:

• Increased childhood health problems, such as speech and language delays, hearing problems, kidney damage, etc.
• Decreased school performance
• The damage done by lead poisoning is permanent and lifelong

Lead can be found:

• In houses located in the city, suburbs, or in rural areas
• In apartments, single-family homes, private and public housing, and day care centers
• Inside and outside of the house
• In soil around your home
• In your water
  

Lead Disclosure

Before the closing of a contract for housing sale or lease, the following is required:

• Sellers and landlords must disclose known lead-based paint hazards and provide available reports to buyers and renters

• Sellers and landlords must give buyers and renters the pamphlet titled "Protect Your Family From Lead In Your Home." You may find this brochure at https://www.epa.gov/lead/protect-your-family-lead-your-home-english

Homebuyers get a 10-day period to conduct a lead-based paint inspection at their expense. Sales contracts and leases must include certain notification and lead-paint disclosure language. Sellers, landlords, and real estate agents share responsibility for ensuring compliance.

What is not required:

This rule does not require testing or removal of lead-based paint by sellers or landlords.

Effective dates:

For owners of more than 4 dwellings units, the effective date is September 6, 1996. For owners of 4 or fewer dwellings units, the effective date is December 6, 1996.
